Terms of Use

These Terms of Service govern your (“you” or the “User”) access to and use of the cerity.com website, including the online quoting and purchasing applications running within cerity.com (collectively, the “Services”). References to “User” in these Terms of Service means you as the User, User’s authorized representatives, and any entity User may represent in connection with User’s use of the Services. References to “Cerity” in these Terms of Service means Cerity Services, Inc.

Agreement to be Legally Bound by these Terms of Service

By clicking “I ACCEPT” or by accessing or using the Services, you agree that you have reviewed these Terms of Service and have agreed to be legally bound by them.

All information provided through the Services is subject to change without notice, including these Terms of Service. You are bound by any revisions and should occasionally review this section for changes. Cerity may terminate, suspend, or discontinue all or part of this website at any time, without notice to you.

If you do not agree with these Terms of Service, please exit the Services.

Intellectual Property

Cerity owns and operates the Services. No materials from the Services may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way without the written permission of Cerity. You may download and print material displayed in the Services for your own use only, provided that you also retain all copyright and other proprietary notices contained on the materials. You may not distribute, modify, transmit, reuse, repost, or use the content of the Services for public or commercial purposes without the written permission of Cerity.

The Services contain Cerity and third-party trademarks, service marks, trade names, logos and icons which are the property of, or used with permission by, Cerity. All marks are the property of its respective companies. All rights in the intellectual property contained in the Services, including copyright, trademarks, trade secret and patent rights, are reserved. Access to the Services does not constitute a right to copy or use any of the intellectual property of Cerity. Any unauthorized use of images may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes. Your use of the trademarks displayed on the Services, or any other content, except as provided herein, is strictly prohibited unless specifically permitted by Cerity. Cerity® is a registered trademark of Cerity Services, Inc.

Privacy

Cerity values and protects the privacy of User’s information. User agrees to review Cerity’s Privacy Policy. User acknowledges and agrees that except as otherwise described in these Terms of Service, any information User provides, or Cerity collects, in connection with the Services, including User Content, will be used and otherwise processed in accordance with Cerity’s Privacy Policy. User is responsible for all information, including personal information, that User provides in connection with the Services. User represents and warrants that its collection, use, and provision of information in connection with the Services complies with all applicable privacy and data protection laws and regulations.

Disclaimer

Cerity makes no representation that information and materials on this website are appropriate or available for use in any location. Anyone who accesses this Website does so voluntarily and is responsible for compliance with all laws and regulations. The user may not rely on statutes or regulations in this Website as accurate but should consult the actual text of the law or regulation or your legal counsel or other professional as necessary.

The information contained on this website, unless expressly stated herein, is not an offer to sell or a solicitation to buy any insurance product or other product or service by Cerity. No insurance product or other product or service is offered or will be sold by Cerity or, if sold by Cerity, will be effective in any jurisdiction in which such offer or solicitation, purchase or sale would be unlawful under the insurance or other laws of such jurisdiction.

Any coverage descriptions provided on Cerity’s website are general descriptions of available coverages and are not a statement of contract. To obtain coverage, User must submit an application through the Cerity Services or by contacting Cerity’s customer service team at 1-844-4CERITY. All applications are subject to underwriting approval. Coverages and availability may vary by jurisdiction. Cerity reserves the right to determine eligibility for the Services in its sole discretion. Not all of the products or services described on cerity.com are available in all States or User may otherwise not be eligible. All insurance purchasing conclusions and decisions, including, but not limited to, coverage amounts, limits, and deductibles are completely and solely the responsibility of the User.

Cerity offers deductibles on some policies in some states. User agrees that if User wants to purchase a deductible policy, User must contact Cerity’s customer service team at 1-844-4CERITY, through the chat feature, or by emailing Cerity at service@cerity.com. Whether or not a deductible policy is issued is in the sole and absolute discretion of Cerity.

If a policy is issued, User is encouraged to review the User’s policy documentation. At the time of a claim, coverage will be determined in accordance with the terms and conditions of the insurance policy and applicable state law. Further, nothing therein should be construed as rendering tax, legal, investment, or accounting advice.

Cerity provides the Services for the convenience of the User. Cerity will correct errors and omissions when they come to our attention in as timely a manner as possible. We welcome all parties to inform us of possible errors, omissions, or ambiguities by e-mail at service@cerity.com.

USER EXPRESSLY UNDERSTANDS AND AGREES THAT: (a) USER’S USE OF THE SERVICES AND THE PURCHASE AND USE OF ANY PRODUCTS OR SERVICES ARE ALL AT USER’S SOLE RISK. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CERITY EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON- INFRINGEMENT; (b) CERITY DOES NOT WARRANT THAT (i) THE SERVICES WILL MEET ALL OF USER’S REQUIREMENTS; (ii) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; OR (iii) ALL ERRORS IN THE SOFTWARE OR SERVICES WILL BE CORRECTED; (c) ANY MATERIAL OR CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICES IS DONE AT USER’S OWN DISCRETION AND RISK AND USER IS SOLELY RESPONSIBLE FOR ANY DAMAGE TO USER’S COMPUTER OR OTHER DEVICE OR LOSS OF DATA RESULTING FROM THE DOWNLOAD OR USE OF ANY SUCH MATERIAL; (d) NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY USER FROM CERITY OR THROUGH OR FROM THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS OF SERVICE.

NOTHING IN THESE TERMS OF SERVICE (INCLUDING THE LIMITATION OF LIABILITY PROVISIONS) IS INTENDED TO EXCLUDE OR LIMIT ANY CONDITION, WARRANTY, RIGHT OR LIABILITY WHICH MAY NOT BE LAWFULLY EXCLUDED OR LIMITED. CERITY MAY CHANGE THE PROGRAMS, PRODUCTS OR SERVICES MENTIONED AT ANY TIME WITHOUT NOTICE. ADDITIONALLY, ALL INSURANCE PRODUCTS REFERRED TO IN THIS WEBSITE ARE SUBJECT TO AVAILABILITY AND QUALIFICATIONS. PRODUCT TERMS, CONDITIONS, AND EXCLUSIONS NOT DESCRIBED IN THIS WEBSITE MAY APPLY. REFER TO THE ACTUAL POLICY OR THE RELEVANT PRODUCT OR SERVICES AGREEMENT.

Limitation of Liability

Neither Cerity nor any party involved in producing or maintaining this website will be liable for any direct, incidental, consequential, indirect, or punitive damages that may result from the use of, or the inability to use, the materials on this website, even if you, Cerity or a Cerity authorized representative has been advised of the possibility of such damages. In no event shall Cerity’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing this website. Reference in this website to any specific commercial products, processes, or services, or the use of any trade, firm or corporation name is for the information and convenience of the users of the website and does not constitute endorsement or recommendation by Cerity, or its employees or agents. Cerity has no responsibility or liability for any damages as a result of access to this website or use of any materials, hyperlinks or references from this website.

To the fullest extent permitted by law, User expressly understands and agrees that in no event will Cerity, its subsidiaries, affiliates, and licensors, and each of their respective officers, employees, agents, and successors be liable to user for any direct, indirect, incidental, special, consequential or exemplary damages resulting from: (I) the use or the inability to use the services; (II) unauthorized access to or the loss, corruption or alteration of User’s transmissions, content or data; (III) statements or conduct of any third party on or using the service, or providing any services related to the operation of the service; (IV) Cerity’s actions or omissions in reliance upon User’s account information and any changes thereto or notices received therefrom; or (V) any other matter relating to the service.

EACCESS

If you purchase insurance through this application, you agree to enroll and maintain an account in EMPLOYERS® EACCESS® portal located at eaccess.employers.com. You will have access to policy documents and payment options inside of EACCESS.

In order to use EACCESS, you must have internet access, an email address, and a web browser. You acknowledge and agree that you have the tools necessary to access and use EACCESS.

Recurring Payments

The Services may include automatically recurring payments for periodic charges, such as a monthly or annual premium, depending on User’s selection (“Recurring Payments”). If User activates Recurring Payments, User authorizes Cerity to periodically charge, on a go-forward basis and until cancellation of either the Recurring Payments or User’s account, all accrued sums on or before the payment due date for the accrued sums. User understands and agrees that the amount of any Recurring Payments may change depending on policy changes User initiates and other factors approved by insurance regulatory authorities. User will be notified of these changes via policy endorsement. If User does not make required payment, User’s insurance policy will be canceled.

User’s policy is issued for a one-year period with automatic renewal for recurring one-year terms. Cerity will determine if policy will be automatically renewed at least 45 days prior to the renewal effective date and will notify User at the User’s email or U.S. Mail at least 45 days prior to the renewal effective date. Should Cerity choose to insure User for another year, Cerity will automatically charge the card for the new monthly or annual premium. Cerity will do the same for any subsequent renewals. User may cancel Recurring Payments by contacting Cerity’s customer services team at 1-844-4CERITY, by contacting Cerity through the chat feature, or by emailing Cerity at service@cerity.com. User must cancel User’s policy prior to the renewal effective date to avoid renewal of the policy and billing of the Recurring Payments for the renewed policy.

Communications

You agree that all records, documents, transactions, and correspondence provided to you by Cerity will be delivered in electronic form and acknowledge that documents will not be delivered in paper form. This includes, but is not limited to, the following documents: policy documents, endorsements, amendments, disclosures, reports, billing statements, invoices, and payment schedules. You further agree that any notices, agreements, disclosures, or other communications that Cerity sends to you electronically will satisfy any legal communication requirements, including that those communications be in writing. However, there may be instances in which Cerity deems it appropriate or is required by law to deliver paper documents to you. In those instances, you will receive paper documents via U.S. Mail. In addition to transactional emails, Cerity may send additional emails to you, including, but not limited to, service announcements, administrative messages, and other information.

Electronic documents will be available in EACCESS located at eaccess.employers.com. You acknowledge that the email provided is an accurate and current email address, and that, if your email address changes, you must notify Cerity by calling Customer Service at 1-844-4CERITY. You may withdraw this consent and request to receive communications from Cerity in paper form by changing your delivery preferences inside of EACCESS. You may also request a printed copy of a specific document by contacting Cerity’s customer service team at 1-844-4CERITY, through the chat feature, or by emailing Cerity at service@cerity.com.

The Services may contain links to other sites which are not maintained by Cerity. Cerity is not responsible for the content of those sites. Please be aware that we do not control or guarantee the accuracy, relevance, timeliness, or completeness of this outside information. The inclusion of any link to such sites does not imply endorsement or recommendation of the sites by Cerity.

Governing Law and Venue

The laws of the United States of America and the state of Nevada govern these Terms of Service. You agree that any legal action between you and Cerity arising from or relating to use of this website shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Nevada. To the extent that any portion of this Terms of Service is invalidated by a court of competent jurisdiction, the remainder of the Terms of Service shall survive with full force and effect.

Updated Terms of Service for Existing Users

Cerity has discontinued the use of its policyholder portal.

For existing Users, the following outlines the change in Terms for communications and payments.

Communications

For policies with a policy number that starts with WC###

Copies of existing documents can be obtained by contacting Cerity’s customer service team at 1-844-4CERITY, by contacting Cerity through the chat feature, or by emailing Cerity at service@cerity.com.

Documents issued after December 6, 2023 will be delivered via email or U.S. Mail.

For policies with a policy number that starts with DWC###

All records, documents, transactions, and correspondence provided to you by Cerity will continue to be delivered in electronic form. This includes, but is not limited to, the following documents: policy documents, endorsements, amendments, disclosures, reports, billing statements, invoices, and payment schedules. There may be instances in which Cerity deems it appropriate or is required by law to deliver paper documents to you. In those instances, you will receive paper documents via U.S. Mail.

Electronic documents will be available in EACCESS® located at eaccess.employers.com. At renewal, you will receive an email at the address provided with information about enrolling in EACCESS. If your email address changes, you must notify Cerity’s customer service team at 1-844-4CERITY. You may withdraw your consent to receive documents electronically by changing your delivery preferences inside of EACCESS. You may also request a printed copy of a document by contacting Cerity’s customer service team at 1-844-4CERITY, through the chat feature, or by emailing Cerity at service@cerity.com.

Payments

For policies with a policy number that starts with WC###

If the User previously enrolled in recurring credit card payments, User authorized and Cerity will continue to periodically charge, on a go-forward basis and until completion of the existing policy, all accrued sums on or before the payment due date for the accrued sums. User understands and previously agreed that the amount of any Recurring Payments may change depending on policy changes User initiates and other factors approved by insurance regulatory authorities. User will be notified of changes in amount of payment via email or U.S. Mail at the time the User initiates the change. If User’s credit card expires or if User changes credit cards, User will have to make payments via check or money order to the address below for the remainder of the policy period.

User may cancel recurring credit card payments by contacting Cerity’s customer service team at 1-844-4CERITY, by contacting Cerity through the chat feature, or by emailing Cerity at service@cerity.com. If User cancels recurring credit card payments, User must make payments via check or money order to the address below for the remainder of the policy period.

If the User previously enrolled in recurring ACH payments, User must submit payment via check or money order to:

User must use the eBilling module inside of EACCESS to make premium payments electronically. You may also pay by check or money order by mailing it to the following address:
